This Privacy Policy explains how TRAKE collects, uses, shares, and protects personal data of Workers, Businesses, and their representatives ("you") who use the TRAKE website, app, or Services. By using the Platform, you consent to the practices described here.

2. What Data We Collect

We collect personal data across the following key categories:

We collect data directly from you (registration, KYC), automatically (app usage, GPS during Shifts), and from third parties (verification agencies, payment partners) where necessary for the Services.

3. Why We Collect It (Purpose & Legal Basis)

We process personal data to:

  • Verify identity and eligibility of Workers and Businesses (consent and legitimate use for platform integrity).
  • Match Workers to Shifts and confirm attendance via GPS (contractual necessity).
  • Process Wallet payouts and Business invoicing (contractual necessity, legal obligation under tax/AML law).
  • Provide customer support and resolve disputes.
  • Improve the Platform, prevent fraud, and ensure safety.
  • Comply with legal, regulatory, and law-enforcement requests.

Where consent is the basis for processing (e.g. optional marketing communications, non-essential cookies — see our Cookie Policy), you may withdraw it at any time without affecting the lawfulness of processing carried out before withdrawal.

4. How We Share Data

We share personal data only as strictly necessary:

  • With Businesses: Limited Worker verification status and attendance data needed to confirm Shift completion (not full ID documents, unless required for statutory compliance).
  • With payment partners: UPI and banking rails to process payouts and invoices.
  • With verification partners: Background-check agencies solely for Worker onboarding.
  • With regulators or law enforcement: Where legally mandated.
  • With service providers: Cloud hosting, analytics, and security infrastructure under strict confidentiality obligations.

We do not sell personal data to third parties for independent marketing purposes.

5. Data Retention

We retain personal data only as long as necessary for the stated purposes, or as required by applicable law (such as financial records under Indian tax law retention periods). Verification documents are retained for the duration of active registration plus applicable post-deactivation statutory limits, after which they are securely purged or anonymized.

6. Your Rights (Digital Personal Data Protection Act, 2023)

Subject to applicable Indian law, you have the right to:

  • Access a summary of personal data we hold about you and the processing activities.
  • Request correction or completion of inaccurate or incomplete data.
  • Request erasure of personal data that is no longer necessary for the stated purpose.
  • Withdraw consent for consent-based processing at any time.
  • Nominate another individual to exercise these rights on your behalf in case of incapacity.

7. Data Security & Cross-Border Transfer

We apply robust technical and organizational safeguards (TLS encryption in transit, strict role-based access control, secure credential management) consistent with the Information Technology Act, 2000. Where data is stored on secure cloud infrastructure located outside India, we ensure it receives an equivalent standard of protection in accordance with DPDP Act regulations.

8. Children's Data

The TRAKE Platform is strictly for enterprise workforce management and individuals aged 18 and above. We do not knowingly collect personal data from minors. If we discover that a minor's information has been submitted, it will be deleted immediately.

We acknowledge privacy and grievance requests within 24 hours and aim to resolve them within 15 working days, in line with Rule 3(2) of the Information Technology Rules, 2021 and the DPDP Act, 2023.

We may update this Privacy Policy periodically. Material changes will be communicated via the Platform or registered contact channels. The "Effective Date" at the top of this document indicates the latest revision.
